What Is the EU AI Act?

The EU AI Act (officially Regulation (EU) 2024/1689) is a binding European Union law that establishes harmonised rules for the development, placing on the market, and use of artificial intelligence systems within the EU — making it the world's first comprehensive regulatory framework for AI. Proposed by the European Commission in April 2021, politically agreed in December 2023, and formally adopted in May 2024, the Act was published in the Official Journal on 12 July 2024 and entered into force on 1 August 2024.

The Act operates on a risk-based model. Rather than regulating AI technology itself in abstract, it regulates AI applications according to the level of risk they pose to health, safety, and fundamental rights. An AI spam filter sits at the same end of the spectrum as a conversational chatbot. An AI system making decisions about credit, employment, law enforcement, or healthcare sits at the other end — and faces mandatory conformity assessments, technical documentation, human oversight requirements, and registration in an EU database before deployment.

The territorial scope is extraterritorial in the same way as GDPR. The Act applies to providers placing AI systems on the EU market regardless of where they are established, deployers of AI systems located in the EU, and providers and deployers located outside the EU where the output of the AI system is used within the EU. The Four-Tier Risk Classification System +

The EU AI Act assigns every AI system to one of four risk tiers — unacceptable, high, limited, or minimal — and the tier determines what obligations, if any, apply to the provider and deployer of that system. Most AI systems currently in commercial use fall into the limited or minimal categories. The regulatory burden concentrates heavily on high-risk systems, while a small set of applications are banned outright.

Tier 1 — Unacceptable Risk (Prohibited)

Eight categories of AI applications are banned under Article 5 because their risks to fundamental rights and human dignity are judged incompatible with EU values. These include social scoring systems, subliminal manipulation, real-time biometric identification in public spaces for law enforcement (with narrow exceptions), and AI systems that exploit vulnerabilities based on age, disability, or socio-economic circumstances. Prohibited AI systems became unenforceable on 2 February 2025 — the earliest application date in the Act's phased rollout.

Tier 2 — High Risk

High-risk AI systems face the Act's heaviest obligations — mandatory risk management systems, data governance requirements, technical documentation, conformity assessments, registration in the EU AI database, and post-market monitoring. They are defined in two ways: systems covered by existing EU product safety legislation in Annex I that require third-party conformity assessments; and systems listed in Annex III covering eight use-case categories including biometrics, employment screening, credit decisions, law enforcement, education, and critical infrastructure.

Tier 3 — Limited Risk

Limited risk systems face lighter transparency obligations rather than full conformity requirements. Providers and deployers of chatbots and conversational AI must inform users that they are interacting with an AI. Providers of AI that generates synthetic content — deepfakes, AI-generated text, images, audio, video — must label outputs as artificially generated. The intent is to protect users from deception without imposing the full compliance burden appropriate to high-risk applications.

Tier 4 — Minimal Risk

The majority of AI applications currently on the EU market — spam filters, recommendation engines, AI-enabled games, and most productivity tools — fall here. No mandatory obligations apply, though the Commission encourages voluntary codes of conduct. This tier was deliberately broad to avoid over-regulating low-harm applications and preserve European AI competitiveness.

Prohibited AI Practices — Article 5 in Full +

Article 5 of the EU AI Act bans eight categories of AI practices that are deemed to pose an unacceptable risk to fundamental rights, safety, or human dignity — with enforcement of these prohibitions beginning 2 February 2025, six months after the Act entered into force.

1. Subliminal and Manipulative Techniques

AI systems that deploy techniques below the threshold of consciousness or that deliberately manipulate users through deceptive means — distorting behaviour in ways that cause significant harm — are banned. This captures both hidden influence mechanisms and systems designed to exploit psychological biases to override rational decision-making.

2. Exploitation of Vulnerabilities

Systems that exploit vulnerabilities arising from age, disability, or socio-economic situation — causing behavioural distortion that results in significant harm — are prohibited. The inclusion of socio-economic vulnerability is a deliberate extension beyond typical protected characteristics.

3. Social Scoring by Public Authorities

AI systems used by public authorities — or on their behalf — to evaluate or classify individuals based on social behaviour or personal characteristics over time, in ways that lead to detrimental or unfavourable treatment, are banned. This is the provision directly targeting systems of the type operated by certain non-EU states.

4. Individual Criminal Risk Assessment Based on Profiling Alone

Assessing the risk that an individual will commit a criminal offence solely based on profiling or the assessment of personality traits and characteristics is prohibited. This does not ban risk assessment tools that use objective, verifiable facts linked to actual criminal activity — the prohibition targets pure personality profiling without factual anchors.

5. Untargeted Facial Recognition Database Scraping

Compiling or expanding facial recognition databases by untargeted scraping of facial images from the internet or CCTV footage is banned. This provision addresses the mass-scale collection of biometric data without consent that several commercial AI providers have pursued.

6. Emotion Recognition in Workplaces and Education

AI systems inferring emotions in workplace or educational contexts are prohibited, with narrow exceptions for medical or safety reasons. This captures systems that claim to assess employee engagement, student attention, or performance using emotional signals — a category that grew rapidly during the pandemic.

7. Biometric Categorisation Inferring Sensitive Attributes

Systems that categorise individuals based on biometric data to infer or deduce race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation are banned — with technical exceptions for lawfully acquired biometric datasets used for labelling or filtering, and law enforcement categorisation under strict conditions.

8. Real-Time Remote Biometric Identification in Public Spaces (Law Enforcement)

Real-time remote biometric identification systems used by law enforcement in publicly accessible spaces are generally prohibited. Narrow exceptions permit use when searching for missing persons, preventing imminent terrorist attacks, or identifying serious crime suspects — but each deployment requires prior judicial or independent administrative authority authorisation, fundamental rights impact assessment, and EU database registration.

Practitioner Note

In my work reviewing AI system portfolios for organisations operating in the EU, Article 5 compliance is rarely about clearly prohibited systems — most organisations have already excluded obvious categories. The subtler issues arise in three areas: emotion recognition tools marketed as "engagement analytics," personality-profiling systems embedded in HR platforms, and retrospective biometric database projects. If your organisation uses any vendor tool touching these domains, treat a compliance review as urgent — enforcement began February 2025.

High-Risk AI Systems: Requirements and Annex III Use Cases +

High-risk AI systems must satisfy eight mandatory requirements before they can be placed on the EU market or put into service — covering risk management, data governance, technical documentation, record-keeping, transparency, human oversight, accuracy, and quality management. These requirements apply from 2 August 2026 for systems listed in Annex III.

The Eight Requirements for High-Risk AI Providers

Risk Management System (Article 9): A documented risk management system must operate throughout the AI system's entire lifecycle — not just at initial deployment. This includes identifying and analysing known and reasonably foreseeable risks, adopting appropriate risk management measures, and testing the effectiveness of those measures.

Data and Data Governance (Article 10): Training, validation, and testing datasets must meet quality criteria — relevant, sufficiently representative, free from errors to the extent possible, and complete relative to the intended purpose. Data governance practices must be documented. This is where the intersection with ISO 27001 (information security) and ISO 42001 (AI management) becomes practically significant.

Technical Documentation (Article 11): Technical documentation must be prepared before placing the system on the market and kept up to date throughout its lifecycle. Annex IV specifies the required contents, including a general description, design specifications, monitoring and validation procedures, and post-market monitoring information.

Record-Keeping / Automatic Logging (Article 12): High-risk AI systems must be designed to enable automatic recording of events — logs — that allow for post-hoc investigation of incidents and monitoring of system operation throughout the lifecycle.

Transparency and Information Provision (Article 13): Providers must supply instructions for use to deployers, including the identity and contact details of the provider, intended purpose, performance specifications and limitations, conditions under which the system can be expected to operate correctly, and how to implement human oversight.

Human Oversight (Article 14): High-risk AI systems must be designed to enable effective oversight by natural persons during the period of use. Deployers must be able to monitor operation, intervene and override outputs, and ensure that the individuals exercising oversight understand the system sufficiently to detect and address risks.

Accuracy, Robustness, and Cybersecurity (Article 15): High-risk AI systems must achieve appropriate levels of accuracy for their intended purpose, be resilient to errors and inconsistencies, and implement cybersecurity measures appropriate to the risks. The Act recognises that adversarial attacks on AI systems — including model poisoning and evasion attacks — are legitimate threats requiring mitigation.

Quality Management System (Article 17): Providers must establish a documented quality management system covering all aspects of compliance — policies, procedures, roles, responsibilities, resource allocation, document management, and internal audit. This requirement alone is a strong signal that EU regulators expect AI governance to be institutionalised, not ad hoc.

Annex III High-Risk Use Cases

The following Annex III categories define the use cases treated as high-risk. Providers whose systems fall in these categories but believe their system is not high-risk must document that assessment before market placement.

General-Purpose AI (GPAI) Models +

All providers of General-Purpose AI models — defined as AI models trained with large amounts of data using self-supervision that display significant generality and can perform a wide range of distinct tasks — must meet four baseline obligations, with additional requirements applying to those presenting systemic risk. GPAI obligations became enforceable on 2 August 2025.

Baseline Obligations for All GPAI Providers

All GPAI model providers must: (1) draw up and maintain technical documentation including training and evaluation processes; (2) provide documentation to downstream providers sufficient for them to understand capabilities and limitations; (3) establish and maintain a policy to respect the EU Copyright Directive; and (4) publish a summary about the content used for training the model. Open-source models with publicly available weights are exempt from requirements 1 and 2, unless they present systemic risk.

Systemic Risk GPAI Models

A GPAI model is presumed to present systemic risk when the cumulative compute used for training exceeds 10²⁵ FLOPs. Providers of systemic risk models must additionally: conduct and document adversarial testing (red-teaming); assess and mitigate systemic risks including potential cascading effects across the value chain; track, document, and report serious incidents to the AI Office; and implement adequate cybersecurity protections. The AI Office may also designate a model as systemic based on high-impact capabilities even without meeting the compute threshold.

As of mid-2025, only a small number of foundation model providers — predominantly large US technology companies — are expected to meet the systemic risk threshold. However, any enterprise that integrates these models into high-risk AI systems becomes a deployer with its own obligations.

The GPAI Code of Practice

The Act established a voluntary Code of Practice mechanism for GPAI model providers to demonstrate compliance until harmonised technical standards are developed. The Code was required to be finalised by 2 May 2025. Compliance with the Code creates a presumption of conformity with GPAI obligations, though providers may also use alternative adequate means subject to Commission approval.

Roles and Obligations: Providers vs Deployers

The EU AI Act assigns fundamentally different obligations to providers (those who develop or place AI systems on the market) and deployers (those who use AI systems in a professional context) — and understanding which role your organisation occupies is the first step of any compliance programme.

Providers bear the heaviest burden. They are responsible for ensuring that their AI system meets all applicable requirements before market placement, maintaining technical documentation, registering high-risk systems in the EU database, conducting conformity assessments, and establishing post-market monitoring. A provider headquartered outside the EU must appoint an EU-based authorised representative.

Deployers — enterprises and organisations that use AI systems in professional settings — have lighter but non-trivial obligations. For high-risk AI systems, deployers must implement human oversight, use systems only for their intended purpose, monitor systems for risks not identified by the provider, report serious incidents, and conduct fundamental rights impact assessments when using AI in public services.

A deployer becomes a provider under the Act if they substantially modify a high-risk AI system, train an AI system for a new purpose covered by Annex III, or place a private-label AI system on the market under their own name. Many enterprises building on top of foundation models — fine-tuning, embedding, or repackaging — may cross this threshold without realising it.

Compliance Signal

The provider/deployer distinction is the single most consequential structural question in EU AI Act compliance. Organisations that mistakenly classify themselves as deployers when they are functionally acting as providers will face the full provider burden — including conformity assessment — without having built the necessary systems. Role mapping must be done before any other compliance activity.

Implementation Timeline (2024–2030) +

The EU AI Act applies in phases, with the most critical milestone for the majority of affected organisations being 2 August 2026, when the full high-risk AI system requirements become enforceable.

For SMEs and startups, the fines are capped at whichever figure is lower — meaning a startup with €10 million annual turnover faces a maximum of €700,000 (7%) rather than €35 million for the most serious prohibited practice violation. Member States may impose additional administrative sanctions beyond the Act's minimums and may create national penalty frameworks for violations by public bodies, which cannot themselves be fined under the EU framework.

Enforcement of GPAI obligations sits with the AI Office at the European Commission level. Enforcement of high-risk AI system requirements sits with national market surveillance authorities designated by each Member State — all of which must be in place by 2 August 2025. The AI Office also coordinates the handling of cross-border cases and maintains oversight of systemic risk.

Governance Structure: The AI Office and Member States

The EU AI Act establishes a two-level governance architecture — the European AI Office at the Commission level for GPAI oversight, and national competent authorities at the Member State level for high-risk AI system enforcement — with an AI Board providing coordination across both levels.
